AMAUI VILLAS AT MAUNA KEA RESORT - PHASE 2 Owner-Occupant Sales Notice This Notice is published in accordance with Section 514B-95.5 of the Hawaii Revised Statutes ("HRS") to inform prospective owner-occupant purchasers that HAPUNA D3 LLC (the "Developer") is currently developing Phase 2 of a condominium project located at Ouli, Waimea, District of South Kohala, Island and State of Hawaii, known as "AMAUI VILLAS AT MAUNA KEA RESORT" (the "Project"). The lands upon which the Project is located are identified by Tax Map Key No. (3) 6-2-021: 003. Phase 2 of the Project consists of five (5) fee simple residential condominium units contained in five (5) one-story residential buildings and five (1) associated one-story or two-story garage buildings. In accordance with Section 514B-96 of the Hawaii Revised Statutes, the Developer does hereby designate the three (3) fee simple residential condominium units identified below as the Owner-Occupant Units of Phase 2 of the Project which constitute (a) at least fifty percent (50%) of all of the residential condominium units in Phase 2 of the Project, (b) a proportionate representation of all of the residential condominium units in Phase 2 of the Project, and (c) initially shall be offered only to prospective purchasers who have signed an owner-occupant affidavit stating that they will use the residential condominium unit as their principal residence for a period of not less than three hundred sixty-five (365) consecutive days.
